Terms of Use

1. Acceptance of Terms

By accessing or using the SkyRent website (skyrent.ca), mobile application, or any related services (collectively, the "Platform"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the Platform.

The Platform is operated by Skyrent Incorporated ("SkyRent," "we," "us," or "our"), a corporation incorporated under the laws of Ontario, Canada.

2. Eligibility

You must be at least 18 years of age and legally capable of entering into binding contracts to use the Platform. By creating an account, you represent and warrant that you meet these requirements.

3. Account Registration

• You must provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Platform Services

4.1 For Renters

The Platform allows renters to search for rental properties, view listing details, submit rental applications, communicate with landlords, and manage their rental experience.

4.2 For Landlords

The Platform allows landlords and property managers to list rental properties, receive and review applications, communicate with prospective tenants, and manage their properties.

4.3 Platform Role

SkyRent is a platform that connects renters and landlords. We are not a party to any rental agreement between users. We do not own, manage, or control any properties listed on the Platform. We are not a real estate broker or agent.

5. Listing and Content Standards

When posting listings or content on the Platform, you agree to:

• Provide accurate and truthful information about properties
• Only list properties that you own or are authorized to rent
• Include accurate photos that represent the current condition of the property
• Comply with all applicable federal, provincial, and municipal laws, including the Ontario Residential Tenancies Act
• Not post discriminatory content or refuse tenants based on protected grounds under the Ontario Human Rights Code
• Not post misleading pricing, hidden fees, or deceptive descriptions

We reserve the right to remove any listing or content that violates these standards without prior notice.

6. Rental Applications

• Renters submit applications directly to landlords through the Platform.
• Landlords are responsible for evaluating applications in compliance with applicable laws.
• SkyRent does not guarantee the approval of any application.
• Personal information provided in applications must be handled in accordance with our Privacy Policy and applicable privacy laws.
• Landlords may not request application fees through the Platform unless permitted by applicable law.

7. Payments and Fees

• Certain features of the Platform may require payment of fees (e.g., premium landlord subscriptions).
• All fees are in Canadian dollars (CAD) unless otherwise stated.
• Payments are processed through Stripe, a third-party payment processor. By making a payment, you agree to Stripe's terms of service.
• Subscription fees are billed on a recurring basis and may be cancelled at any time.
• Refunds are handled on a case-by-case basis at our discretion.

8. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose
• Post false, misleading, or fraudulent listings or information
• Harass, threaten, or intimidate other users
• Scrape, crawl, or use automated means to access the Platform without our written consent
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Platform's infrastructure
• Use the Platform to distribute spam, malware, or unsolicited communications
• Circumvent any access controls or usage limits
• Reproduce, distribute, or create derivative works from the Platform without authorization

9. Intellectual Property

The Platform, including its design, code, features, logos, and content created by SkyRent, is the intellectual property of Skyrent Incorporated and is protected by Canadian and international copyright, trademark, and other intellectual property laws.

Content you post on the Platform (such as property photos and descriptions) remains yours. By posting content, you grant SkyRent a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content in connection with the Platform's services.

10. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The Platform will be uninterrupted, secure, or error-free
• Listing information is accurate, complete, or current
• Any property meets any particular standard or condition
• Any user is who they claim to be

11. Limitation of Liability

To the maximum extent permitted by law, Skyrent Incorporated, its directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform, including but not limited to:

• Disputes between renters and landlords
• Property conditions, misrepresentations, or undisclosed defects
• Loss of data or unauthorized access to your account
• Any transaction or relationship between users

Our total liability for any claim shall not exceed the amount you paid to SkyRent in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Skyrent Incorporated from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.

13. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. You may delete your account at any time through your account settings or by contacting us.

Upon termination, your right to use the Platform ceases immediately. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, and indemnification) will survive.

14. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these Terms or your use of the Platform shall be resolved in the courts of the Province of Ontario, located in Toronto.

15. Changes to These Terms

We may modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Platform and updating the "Last updated" date. Your continued use of the Platform after changes constitutes acceptance of the revised Terms.
